因为一篇刊载在《网络公民》的文章,曾在去年12月和本社总编许渊臣一同被控刑事诽谤的35岁男子迪哥达(Daniel de Costa),针对其指控作出宪法挑战(constitutional challenge)。 不过,今日法庭驳回了迪哥达的申请。在抗辩中,控方强调迪哥斯达因破坏内阁成员名誉,被控刑事诽谤。而哥斯达诽谤的指涉对象,是内阁成员,而不是内阁本身,而法官也赞同控方的立场。 迪哥达由律师拉维(M Ravi)代表辩护。拉维曾指出,他们“将质询,在刑事法典499条下“有关人士之声誉”,依据2017年上诉庭判例,只能诠释作为“自然人”(natural persons only”),那么,文章所指的“内阁”,就不能视为任何意义上的“个人”,也和新加坡宪法23和24条一致。” 宪法第23条阐述行政机构性质;24条则关乎内阁的组成。 迪哥达在去年12月12日,在刑事法典第499条文,以及第500条文下被提控。他被指控在2018年9月4日,电邮了含诽谤内阁成员内容的文章到《网络公民》。其中提及“高层腐败”(corruption at the highest echelons)。 去年9月18日,资讯通信媒体发展局(IMDA),援引《广播法》第16(1)项,要求本社在六小时内撤下被指违规的贴文,本社已遵照该局的指示删除贴文。 资媒局在上述文章被移除后,于10月4日报案。警方在去年11月20日依据庭令,前往搜查本社总编许渊臣住处,并扣押其电脑设备作调查用途。 在刑事法典第500条文下阐明,任何涉及诽谤他人者,一旦罪名成立,可能面对最高两年监禁或罚款,或两者兼施。 针对法庭判决,拉维透露他们将在一周内提呈”刑事动议“,并表示对法官接受控方立场感惊讶,对于部长被人为地区别为政府或内阁,感到困扰。他补充:“从本质上讲,鉴于当前的法律地位,政府机构没有声誉可保护。”
共享脚车业者SG Bike今天宣布,已经成功收购了摩拜(Mobike)的营业执照,成为能够在我国经营2万5000辆脚车的业者,更是我国最大的共享脚车业者。 目前我国还有另外两家获准经营一万辆脚车的共享脚车业者,即随行单车(Anywheel)和Moov Technology(简称Moov)。 面对有关的交易,SG Bike总裁Sean Tay指出,脚车仍然是最灵活的交通工具,因此相信这一共识能让该公司加速共享脚车的使用量。 总部设于北京的摩拜于今年3月,首次宣布计划退出新加坡市场,以作为合理化东南亚业务的努力之一。当时该公司表示正在探索数种可能性,包括将业务转交给其他公司,以最大程度地减少对消费者的影响。 总部设于上海的Obike,也于去年6月突然宣布推出新加坡市场。 应用程序可解锁二公司脚车 由脚车租赁公司Park Cosco Recreation和房地产升级公司ISO Team成立的初创公司,SG Bike于2017年首次以300辆脚车的营运方式,在荷兰武吉班让(Holland-Bukit Panjang)地区亮相。 文告中,SG Bike表示其应用程序可以解锁自家经营以及摩拜的脚车,但是摩拜的应用程序已经不能解锁任何脚车了。 该公司也将在今天开始的试用期期间,提供30分钟的免费租借脚车服务。 “这个试用期将使SG Bike能够更有效的管理新资源,并进行必要性的调整,让共享脚车服务更顺畅。” 该公司并没有指定试用期的截止日期,只说试用期将会在不久后结束,用户也会透过应用程序接到通知。 文告中也指出,脚车的租赁价格保持不变,一周付费为3元90仙,30天付费则为11元90仙。摩拜用户也可以使用之前用于注册账户的手机号码,来创建一个SG Bike户头,从而将之前的积分和租车费转移到SG Bike账户中。 自榜鹅开始部署服务...
日前,失业者互助网站 Transitioning.org创办人吴家和脸书发文,指有清寒子弟原本只能领取小六会考成绩单影本,所幸有好心人帮忙缴清学费,才成功领成绩单正本。 今日吴家和再转发网民留言,该名网友哈兹丽娜(Hazellina)分享自身的遭遇,他们因一时经济拮据无法支付两名孩子的学费,但比较幸运的是,孩子的学校并没有因此被拒绝领成绩单正本。 她公开她与丈夫的收入。哈兹丽娜本身收入达1363新元(未扣除公积金),而丈夫收入也仅约1400-1500元,加起来达2863元。 然而根据教育部官网,要申请经济援助计划(FAS),条件之一是家户总收入必须少过2750元,或人均月入不得超过690元。显然哈兹丽娜一家不符合该条件。 原本住租赁组屋 再者,哈兹丽娜也分享,他们一家才刚在一年前购买四房式的组屋。 至于为何会选择购屋,相信是收入已不符合租赁组屋条件,哈兹丽娜指被建屋局告知他们的公积金已足够买房。他指出,此前他们租赁组屋的月租仅338元。 在建屋局官网则显示,租赁组屋的申请条件,家户总收入需不超过1500元。 仍打起精神过日子 Hazellina称,买房后他们也无多余的钱购置其他家具如床或衣柜,一家人仅睡在床垫,其余的钱则必须用于支付生活和交通开销,以及缴付厨房柜的贷款。 尽管生活拮据,但他们仍然必须要打起精神过日子。网友表示,在看见吴家和的帖文后,相当感谢吴家和与其他善心人士的帮忙。 吴家和也感谢文园小学校长的特别通融,让有关学生获得了正本,同时也谢谢为其他孩子解困的善心人士。 家家有本难念的经:无法支付学费,不代表家长忽略孩子成长 从网友所分享的故事便可知尽管有明文规定,但仍法外有情,这也凸显出家家有本难念的经,每个家庭都有其困难和挑战,因此并不能以无法支付学费作为忽略孩子学习成长的标准,也不代表他们都是忽略孩子学费的家长,或许只是面临了生活上的困难,而无法交出学费。 对此,《海峡时报》报道,在消息曝光后,教育部透过媒体澄清该名学生家长已有两年没有支付学费,而且也未向教育部或学校申请任何援助,但孩子仍然会收到一份影印本,可依据影印本申请中学入学。 “在脸书上强调的案例中,由于两年内多次提醒却未获得家长支付学费,而且也未向教育部或学校提出任何援助申请支付费用。尽管如此,孩子仍会受到一份影印本,但并非原始版本的,他依然能够申请入学,与其他同侪共同上课。” 尽管已作出澄清,但也证实,若学费未缴清,有关学生只能拿到影印本而不是成绩单正本,且这是该部“一贯的政策。” 教育部又补充,每年为每位小学生补助约1万2000新元,分担下每个学生每月仅付13元杂费。该部强调低收入家庭可以申请财务援助,来减轻制服、课本、交通、学校伙食和学杂费等负担。 对此,《海峡时报》也向吴家和取得联系,吴家和表示,“这对于孩子而言,真的是令人沮丧的,尤其是他们和同龄人被比较时。” 吴家和也指出,他并不是在怪罪教育部,因为确实透过各项的经济援助,为很多贫困家庭纾困,其学费大多是免费。但有时候部分家庭也会陷入困境,而且也会有“落单”的群体。
