民防服役人员郭俨进中士被推入泵井溺毙一案,今日已有新进展,一级准尉法立(Mohamed Farid Mohd Saleh),被指放任其他人导致郭俨进重伤,期间并未阻止他们,犯下教唆他人做出鲁莽行为导致他人重伤的罪状,罪名成立。 《亚洲新闻台》报道,法官认为努尔法特瓦(Fatwa)的供词即使在辩护律师的严格盘问下,都有一致的证词,因此认定他为可信的证人,采纳法特瓦的供词。 法官指出,基于法特瓦在事发后坦率承认罪行,并对此认罪服刑,因此认定其证词的可信性。“在观察法特瓦的供词后,认为他确实是一个可信的证人,他的证词内涵盖真相”,法官表示。 法特瓦承认在事发当时将郭俨进推入泵井,并表示是受到法立的指示所作,他承认被指控的两项罪名:将行为鲁莽导致他人死亡罪以及妨碍司法公正罪。目前已被判处1年4星期监禁,正在服刑中。 对此,法立则声称法特瓦正在撒谎,为自己辩护,法特瓦在证词表示听见法立以马来语下指“ Wa tolak dia ”(瓦,推他)。瓦即指法瓦特。 法立的律师则表示,法立对法瓦特的撒谎感到失望,并指出他这样做是为了欺骗所有人。但法官则认为,法立的辩解更像是法特瓦不想单独面对指控,亦存在推卸责任的用意,但他相信法特瓦并没有任何理由诬陷法力,基于慎重考虑,驳回辩解。 而针对法立的辩解,法官亦表示,他对于法立试图淡化他个人的参与感到不意外,但也不具备成为可信的证人。 除了法特瓦,另名被告阿迪哈扎里(Adighazali Suhaimi)也在去年12月,因删除重要视频,而被判1个月监禁。其余三名包括法立、消防队长钟志文中尉(38岁,Chong Chee Boon Kenneth)、副队长纳詹一级高级准尉(40岁,Nazhan Mohamed Nazi)的指控仍在审理中。 三人被指放任其他人导致郭俨进重伤,期间并未阻止他们,犯下教唆他人做出鲁莽行为导致他人重伤的罪状。 该意外发生于去年的5月13日,22岁的郭俨进,在大士景消防局庆祝退伍时,因被推入消防局里一口约12米的泵井,不幸溺毙身亡。据悉,当时正在庆祝死者的退役,但死者被指是跳入泵井,死者表示不会游泳但有人认为队内有游泳高手,可以及时将死者救起,岂知在死者进入泵井后便没有再浮出水面,队员跳入水中寻找不过,最后抽干泵井才找到死者,最后送院不治。
