日前本社报导,一名印裔公民,为了能治好妻子的病,向中央公积金局申请,将自己的普通和特别户头存款,转移到妻子的保健储蓄(medisave)户头,好让妻子能继续抗癌。但是,公积金局拒绝了苏利亚的要求。 人权律师拉维于10日在脸书更新近况,表示他的律师团队已经入禀高庭,以申请强制令要求公积金局,准许他领取积蓄籍转移给妻子莎若吉妮户头,作抗癌医疗费用。 不过,公积金局与卫生部于今日(7月12日)发表联合文告,尝试厘清莎若吉妮个案中的一些细节,并解释莎若吉妮的终身健保、个人保险等已为她承担大部分医疗费,且公积金局自2017年以来,已尝试透过各种配套施予援手。 必须注意的是,目前苏利亚提出的诉求,是希望当局能批准他提出自己的公积金普通和特别户头,转移到妻子户口作为治疗费用。惟在文告中当局除了对夫妇俩处境深表遗憾,但未提及条例下55岁才能转移至亲户口的限制,以及是否特别通融现年47岁的苏利亚这么做,拯救爱妻。 在文告中,公积金局解释,自2017年,患有卵巢癌的莎若吉妮,选择在伊丽莎白私人医院和百汇癌症中心(PCC)寻求治疗。百汇癌症中心告知莎若吉妮夫妇,她的癌况近末期已无法治愈。 2018年,她前往国立大学医院咨询第二意见,而她得到的答案亦同。文告解释,国大医院献议莎若吉妮可预约转介到该医院接受津贴治疗。 “莎若吉妮选择继续在私立、无津贴的百汇癌症中心接受治疗, 她的终身健保到目前为止为她支付六万元医疗和住院费用。而加上她的私人保险,保险至今为她支付了30万元,涵盖了她在百汇和伊丽莎白医院90巴仙的医疗费。” 公积金局续解释莎若吉妮获得的保障,指自2017年10月,莎若吉妮可从乐龄健保每月领取1100元,至今累积2万3000元,得以为他们减轻财务负担。 “莎若吉妮和丈夫苏利亚也从他们的健保储蓄中,领取9000元供治疗用途。” 公积金局称,2017年,鉴于百汇癌症中心的评估指莎若吉妮病情严重,她获准从公积金普通和特别户头领取2万5000元。 至于公积金局家庭保障计划( Home Protection Scheme)也为他们承担共18万6500元的未偿还抵押贷款。 公积金局指,针对莎若吉妮的个案,从公积金局允准的保险配套迄今为止为她支付了51万新元,而从他们夫妇俩的公积金户口共去除了3万4000元。 “我们对于这对夫妇面对的困处深表遗憾。自2017年以来已透过各种配套为他们提供支援。我们再次强调津贴医疗仍是这个家庭的选择。如他们在国大医院的医疗面对难处,他们仍可透过保健基金(MEDIFUND)寻求额外财务援助。” 律师拉维:涉及《公积金法》第18(D)条 47岁的印裔妇女莎若吉妮在2016年底被诊断患有卵巢癌,自此他们一家也饱受煎熬,财务状况也陷入困顿。如今莎若吉妮的癌症病况已进入第四期。 对于苏利亚夫妇面对的困境,人权律师拉维此前也表示,他们的个案涉及到《公积金法》第18(D)条,也就是让公积金会员可以把普通和特别户头的存款,转移到至亲的户头,但是只能限定在55岁后才能这么做。 “或许当局也同情莎若吉妮罹癌的情况,但照条例,就只能等到丈夫苏利亚年满55岁,在公积金局同意下才可把存款转移到其妻子医疗储蓄户头。” 对此拉维感到难以置信,他更引述新加坡宪法第九条文:“除非依照法律,不得剝奪任何人的生命或人身自由。”,指这种情况形同在剥夺莎若吉妮的生存权益。 不过,从公积金局的回应声明,除了尝试立场莎若吉妮治疗的细节外,并未正面回应在《公积金法》第18(D)条下,55岁才能转移户头的限制,以及是否会允诺批准苏利亚的诉求。
《防止网络假信息和防止网络操纵法案》在今年5月正式在国会通过,并已在六月25日发布于宪报,正式生效。该法自提呈国会以来即备受争议,不仅在国会引起激辩,包括国内外学术界、媒体、公民组织等都已对该法提出质疑。 其中,本地历史学者覃炳鑫博士发现,律政部也有发布一份指南,以不同范例解释哪些情况下可援引《防假消息法》,例如哪些陈述属于意见,哪些是造假事实。 这份指南指出,可援引该法的条件包括出现虚假事实,以及涉及公众利益。其中一个栏目特别提出学术界研究例子,阐述什么情况下可能出现学者发表虚假陈述。 覃炳鑫博士曾受邀出席去年的国会特选委员会听证会,为如何应对网络假消息提供意见。期间,他因为提及1963年冷藏行动和1987年光谱逮捕行动,目的在于政治利益,而非国家安全问题,批评人民行动党和前总理李光耀,才是假新闻的散播者,引起律政部长尚穆根等人围剿。 覃炳鑫发现,上述指南陈列的其中一个学术界例子,是这样的: J,一名历史研究者,依据各种历史文件推论,指冷藏行动未涉及国家安全问题。 而后指南继续阐释: 针对(ix)的个案,假设J诠释历史文件,尔后又承认他的诠释是不准确的,然后又重复之前的误导性诠释,那么J就是做出了虚假事实陈述。 难道是如有雷同,纯属巧合?虽然上述案例没有指名道姓,但似乎在影射覃炳鑫博士的经历。对此覃博士只得在脸书自嘲:“如果你的政府拿专制立法特别针对你,那也算一种荣幸。” 不过,他也补充,事实是没有任何证据能表明,在冷藏行动下的拘留者涉及参与颠覆国家的共产党阴谋。 针对上世纪50、60年代期间,新加坡是否有共产主义阴谋散布?左翼份子是否受马共唆使企图进行不利新加坡的政治活动,才有必要进行逮捕行动,覃炳鑫在去年的听证会,和尚穆根等人展开六小时的审问拉锯战。 在过程中,尚穆根以“是或不是”、“同不同意”、“你有读过这些资料吗?”“对与否”等威权式的提问,无意与覃炳鑫对话,过度简化复杂的历史争议,其背后意图却是要质疑覃炳鑫历史研究的正当性和理据。 而在去年九月,国会研究蓄意散播假消息特委会发表报告,特别批评历史学者覃炳鑫“撒谎、自抬身份“、罔顾那些否定他虚假指控的资料。 当时,律政部长兼特委会成员尚穆根向媒体表示,委员会的结论是,覃炳鑫谎报自己的学历和学术职位,因此他的陈述不可信。 覃炳鑫也辩称冷藏行动不存在对国家的安全威胁,当他被质疑时,却承认没有阅读或没有将马来亚共产党资深党员的论述考虑在内。最后覃炳鑫也没有提供文件,跟进他所提出的论述。 此事也立即引来公民组织的炮轰。前学运领袖、流亡异议份子陈华彪就批评,这是针对我们最优秀、最勇敢公民的另一次人格诋毁行动。
我国毛广岛(Pulau Bukom)蚬壳公司炼油厂偷油事件,收取“贼赃”的油槽船大副成为昨日(7月11日)被带上庭处理的首名被告,被判两年半的监禁。 去年1月7日,警方在一次行动中,将包括唐文汉(38岁,译音Dang Van Hanh)在内的8名前蚬壳员工和其他员工逮捕。 拥有越南国籍的他,承认曾经四度收取重达5592公吨,总值约259万美元(约350万新元)的被盗燃油。 检察官表示,调查发现也是偷油团伙的两名蚬壳员工,在毛广岛以前所未有的规模窃取燃油。 蚬壳在该岛经营者一家炼油厂,是亚太地区最大的炼油生产和出口中心。 检察官指出,作为偷油计划的一部分,两艘越南船只将进入该炼油厂中,接受合法购买的燃油。但是,他们也采纳蚬壳员工透过其他人的安排,接收他们所盗取的燃油。 警方是接到蚬壳代表于2017年8月进行投报后,开始调查该公司当月4月份损失将近298万新元的燃油。 偷窃燃油可追溯至2014年 去年12月的一项报告显示,总值约1.5亿美元(约2.06亿新元)的炼油厂偷油事件,可追溯到2014年。 当唐文汉在2017年11月被分配到巴拿马注册油槽船Prime South担任大副时,该船的前大幅曾告诉他,该船只曾多次从毛广岛的蚬壳收取类似的非法货物,以赚取外快。 而Prime South于2018年1月4日抵达我国之前,他曾被船长阮德广(47岁, Nguyen Duc Quang)告知要到毛广岛接受非法货物。 去年1月6日,他们接到指令,将船只开到毛广岛的码头停靠,以便收取货物。 行程中,阮德广告诉他,他们将接收大约9000公吨的合法购买燃油,将九个汽油箱装满了。 隔日凌晨约2时,被告在两名蚬壳支援的协助下,将剩余的三个汽油箱装满。当时他的船上共载有总值96万1900余美元(月130万3000余新元),重达1593公吨的被盗燃油。 有关转移工作在凌晨约5时40分完成后,两名蚬壳船员断开输送管后离开船只不久,接到情报并早已恭候多时的警员就上船捉人。 准备配载计划 非首次干案 法官也了解到,唐文汉曾经是油槽船Prime...
