积极抨击菲律宾政府当局的新闻网站拉普勒(Rappler)创办人兼总编玛丽亚蕾莎(Maria Ressa),被指控“网络诽谤”,根据BBC报道指出,她已在拉普勒位于马尼拉的总办公处被捕。 新闻自由维权分子认为,菲律宾政府此举旨在让新闻机构保持沉默。 菲律宾总统杜特蒂,否认有关逮捕行动含有政治动机。 这是对付蕾莎女士中最新的一起案件,杜特尔特更指该新闻网站为“假新闻”。 当局是基于2012年,拉普勒的一则报导以“网络诽谤”(Cyber-libel)法令提控蕾莎。有关报导内容涉及一名富商Wilfredo Keng与菲律宾前最高法院法官Renato Corona之间的利益纠葛。Keng疑似和贩毒和人口走私集团挂钩。 指控诉皆是“捏造”的 当时的报导标题打出:《最高法官借用争议商人休旅车》,当时适逢Corona遭弹劾期间,Keng也否认曾借车,要求拉普勒下架并提控诽谤。 官员们首次于2017年对她提出控诉,但是最初被菲律宾国家调查局(National Bureau Investigation,简称NBI)驳回,因为提出诽谤案件的期限已经失效。提出诽谤案件的期限为一年。然而在2018年3月,NBI重新开启有关档案。 距离在税务欺诈罪下被逮捕仅仅两个月,蕾莎再次面对政府的逮捕,她表示这些控诉都是“捏造”的。 如果她所面对的税务欺诈控诉罪名成立,她将面对10年的监禁刑罚。而“网络诽谤”一旦罪名成立,最高刑罚为12年监禁。 求助法官保释蕾莎 一名资深记者在蕾莎被逮捕后表示,他感到非常震惊,“法制制度已经突破到我无法看到的地步了。” 脸书上上载了数名便衣官员对蕾莎交谈的视频,数名该网站的记者也在场,他们也在推特上进行现场直播。有关的官员曾要求他们停止录影和拍照。 拉普勒新闻编辑,米丽安格蕾丝(Miriam Grace Go)较后在推特发文,指蕾莎由官员们带离拉普勒总部。 蕾莎被逮捕时已经将近晚上,但是该网站的工作人员仍集中精力,以寻找能够协助蕾莎保释的法官。 记者苏菲娅(Sofia Tomacruz)随后在推特上指出,法官们拒绝了他们的要求,这表示蕾莎必须在牢里度过当天晚上。 拉普勒新闻主管Chay Hofileña向BBC新闻网表示,这是他们最担心的情况。“蕾莎目前仍然在国家调查局,我们希望她能够获得保释,以便不用在那里过夜。”...
日前,国防部长黄永宏声称,任何人只要察觉军训做法不安全,便可立即通知上级军官以直接停止训练,无需害怕受到纪律处分。 “我说的很清楚,是任何人可以阻止不安全的军训。”他说,“只要您认为军训方式对你或战友不安全或可能构成伤害,就提出来,我想这是维持实质军训并让父母也安心的做法。” 不过,在前日的国会上,义顺集选区议员李美花也询问,可能一般士兵因为担心会影响部队和谐,或担心被秋后算账而不敢举报。 对此黄永宏称,军训安全守则也写明,任何人只要发现安全疏失,都能停止军训。“军训现场会有监督安全的军官,但士兵可以向任何长官反映问题,或拨打武装部队热线上报。” 他说,要营造一个注意安全的部队风气,绝不容忍安全疏失。 然而, 黄永宏的理想可能和现实差距甚远。面对更高级别的军官,武装部队服役人员似乎难以感受到他们有权利向长官反映问题,因为军队中基本上需要服从命令。其实这也可以透过一些网民分享服役经验、对安全的担忧可以看出端倪。 在军训中举报长官、或军中危险操作的人,往往会面对沉重的压力,即便没有面对光明正大的打压,但有关举报者可能会被长官“标签关注”(marked),在军训中可能被有意无意地增加挑战和困难。 2014年:服役人员举报长官虐狗 反被惩处 本社在2014年曾报导,曾有一名全职国民服役人员,揭发准尉的虐狗行为,却反被惩处。Samuer用相机录下该长官的行径,但他反被指责在军营中擅自录影,最后被罚取消21天的假期,甚至不被允许谈论此事。 至于那名涉虐狗的长官却没被惩处,直到后来才承认错误。事实上,对于举报揭弊的Samuer,他的指挥官也无意惩罚他,但上级仍执意执行。在这种情境下,即便他基于道德原因违反军中严禁录影的规定,但还是因举报行为而被惩处。 对举报者缺乏保障 且不论士兵违反军规的动机,若他们举报上级违规行为就被惩罚,那么对于这些想匿名的举报者根本没有保障。再者,诸如调查死亡事故而启动的独立调查委员会,举报事故的士兵名字也可能会曝光,这也导致许多士兵不太愿意挺身而出,透露真相。 若这些状况没有改善,要求服役人员勇于举报都将沦为空谈,与实际军中情况脱节。
