社运份子范国瀚因邀请香港学运领袖黄之锋,透过视讯Skype连线针对公民议题交流,却因此在昨日被新加坡裁定无准证举办公共集会罪名成立,案件展延至本月23日,让控方针对刑罚陈词和律师求情后再判刑。 法官昨天下判时说,范国瀚举办公共集会,并在面簿宣传。在集会举行前几天,警方曾通知他由于其中一名主讲者不是新加坡人,必须申请准证。但被告却没按照法律规定申请准证。 与此同时,在接受警方调查时,警方先后录了三分口供,警方以口供书属机密文件为由,拒绝提供范国瀚备份,使得范国瀚拒绝在2016年12月20日录的口供书签名。 非法举办公共集会的刑罚是罚款不超过5000元,而拒绝在口供书签名则可被判监最长三个月,或罚款最多2500元,或两者兼施。 范国瀚接受港媒采访 喻新民主空间受限 范国瀚的遭遇也引起包括香港等地的国际媒体关注。《纽约时报》中文网报导,人权观察组织(Human Rights Watch)亚洲分部副主任菲尔·罗伯逊(Phil Robertson)在一则声明中表示“范国瀚因组织和平集会而被起诉,表明新加坡公众集会法律的荒谬,以及政府意在惩罚发声者。” 他认为,新加坡政府应开始听取批评,不再把和平集会视作犯罪,并停止迫害集会的组织者。 香港众志党(Demosisto)秘书长黄之锋,在接受香港自由新闻(HKFP)采访时,直言只因为举办视讯会议交流,就被国家起诉是荒谬的,也证明新加坡法院的保守,对提出异见的社运份子感到恐惧。 其中香港电台视像新闻,早前采访了范国瀚,范在访谈中不违言批评新加坡表面上担保民主权益,但实际上民主空间受限,媒体更不会积极报导新加坡发生的人权问题。 “普通新加坡人也会感到害怕,会自我审查,所以很多我们想说的事,都不会透露出来。” 新加坡唯一官方批准可进行集会的空间—芳林公园演说者角落,但场地使用、集会期间若使用非官方允许的语言,或有外籍人士参与,都必须事先向经费申请。 对此范国瀚在访谈中直言这是很荒谬的,申请准证过程也需要给十四天的通知,但当局考虑核准的时间又没有限制,等到批准来,可能你想谈的议题都过时了。 ““演说者角落”周边也有许多闭路电视,有些活动会有许多警察,虽然他们给你这个空间,但仍有许多限制。” 吁保持斗争精神 针对港新两地对民主权益的争取积极态度比较,他认为目前香港仍比新加坡自由,在香港举办示威活动会较多人出席,港人能展现较勇敢的态度。 但他也提醒,香港人需抱持斗争精神,“因为如果不抗议,政府就会说人民对这个议题,都没有什么抗议、都不争取他们的权益,那政府就把基本权益拿走,新加坡就是这个现象。” 至于另一受访者杜威律师(Alfred Dogwell),则曾为余澎杉辩护。他认为过去余澎杉只是较关心时政,爱表达异见,但他不认同政府施压对付年轻人。 “新加坡政府显得脸皮很薄,对批评无法持开放态度,这不是很好的领袖典范,”“如果你认为你的论点政策是正确的,你一定有能力去捍卫它,而不是把异见者扔进监狱。” 杜威也意识到在香港也出现许多年轻人,包括黄之锋在争取权益时,被强权对付,“政府想在某个议题取得据点,他们会一锤定音,并拿年轻人来“杀鸡儆猴”,对这些年轻人比对成人更苛刻,以传达强烈讯息。”
