44岁新加坡男子苏海(Syed Suhail bin Syed Zin),因面对贩毒罪名成立,原定于上周五(18日)执行绞刑。 不过苏海成功向上诉庭提呈上诉,以进行司法检讨,直至上诉庭聆聆审,前者的执刑将暂缓。 苏海是透过代表律师拉维(M Ravi)提呈司法检讨,申诉公民似乎面对不平等对待。因为冠病疫情关系,一些外籍囚犯的家属由于无法来狮城探访死囚,他们的处刑获押后。但其他死囚如新加坡死囚则可能先被安排上绞刑台。 上诉庭在本月22日聆审苏海的上诉。据拉维的脸书更新贴文,坦言庭上交锋激烈,上诉庭要求总检察署和辩方都要再提呈进一步的陈述。下一次的聆讯定在10月7日。 针对苏海的申诉,内政部还特别发文告,否认在处刑的排期上存歧视成分。不论是外籍囚犯或本国公民, 若试过了所有法律或特赦上诉途径,才会被安排处刑。 当局也指出,2019年进行了四次司法处刑,就包括两名新加坡公民和两名外籍人士,也指苏海的指控毫无根据。 另一方面,苏海申诉本身写给前任代表律师的信函,也被转交给总检察署,监狱署对此作出解释。 2018年5月3日,苏海在上诉庭表示希望能请一名叔叔提供证据。总检察署当时也联系监狱署,核实苏海是否有传召叔叔当辩护证人的意愿。监狱署检查后,得知苏海曾给叔叔写了四封信。 监狱署在2018年5月10日和6月7日,将这些信函副本,以及苏海写给前辩护律师信,抄送给总检察署。当局声称,监狱法令或条例,当时并没有禁止这种做法。 苏海因涉及贩运近40克海洛因,新加坡高庭在2016年月判后者罪名成立。苏海无法证明这批毒品仅供他自己食用,而法庭资料也提及,他也把一包海洛因以5千700元价格卖给他人。
